STATUS OF CIVIL SERVANTS UNDER THE STATESERVICE LEGISLATION OF THE REPUBLIC OF KAZAKHSTAN

Abstract

The subject of the research is the constitutional, legal, economic, social and political foundations associated with public service; organizational foundations, dynamics of the formation of institutions of the civil service system; constitutional and legal responsibility of public authorities and civil servants; factors and conditions for the development of the civil service system in Kazakhstan and the main problems of their modernization. The purpose of this study is to conduct a comprehensive analysis of the national and international theory and practice of the civil service system and its specifics; analysis of the problems of functioning of the mechanism of the civil service system; guaranteed rights of citizens to an effective civil service system in Kazakhstan; identification of the main problems, development and substantiation of solutions to problems. The scientific novelty of the dissertation research is determined by the fact that: a comprehensive and systematic study of general theoretical and practical problems of the formation of an effective civil service system has been carried out; investigated and identified, as well as subjected to a systemic analysis of public service institutions; disclosed the system of civil service; studied the problems of constitutional and legal responsibility in violation of constitutional and legal norms of the civil service system; analysis and identification of the factors of development of the civil service system in Kazakhstan; the author's vision of modernization of legislation in the field of development of institutions of the civil service system is proposed; substantiates the need for a clear consolidation of the constitutional and legal responsibility of civil servants, especially senior government officials; the study presents conclusions and developed proposals that have theoretical and practical significance for the optimization of the Kazakhstani system of civil service; presented an innovative strategy and conceptual model of modernization of the civil service system in the Republic of Kazakhstan, developed and substantiated a number of changes and additions to the current legislation, developed the structure of an innovative bill - the Code "On Civil Service in the Republic of Kazakhstan".
